This paper investigates the task of reference resolution in the legal domain. This is a new interesting task in Legal Engineering research. The goal is to create a system which can automatically detect references and then extracts their referents. Previous work limits itself to detect and resolve references at the document targets. In this paper, we go a step further in trying to resolve references to sub-document targets. Referents extracted are the smallest fragments of texts in documents, rather than the (...) entire documents that contain the referenced texts. Based on analyzing the characteristics of reference phenomena in legal texts, we propose a four-step framework to deal with the task: mention detection, contextual information extraction, antecedent candidate extraction, and antecedent determination. We also show how machine learning methods can be exploited in each step. The final system achieves 80.06 % in the F1 score for detecting references, 85.61 % accuracy for resolving them, and 67.02 % in the F1 score for the end-to-end setting task on the Japanese National Pension Law corpus. Résumé Avec La Source aux fleurs de pêchers, et d’autres œuvres poétiques écrites par Tao Qian au V e siècle, est née une vision de l’utopie qui reste à tout jamais gravée dans l’imaginaire collectif chinois. Treize siècles plus tard, Cao Xueqin s’en inspirera pour donner forme au « Jardin aux sites grandioses », univers aux traits foncièrement féminins et l’un des noyaux de l’intrigue de L’histoire de la pierre, chef d’œuvre de la fiction romanesque chinoise également connu sous le (...) titre « Rêves au pavillon rouge ». Une lecture des deux œuvres en parallèle, tant au sens figuré que littéral, met en lumière le message du Dao De Jing selon lequel l’utopie ne se planifie pas, ne s’impose pas. Elle émerge au contraire d’un esprit de disponibilité, d’une attitude d’attente, d’une écoute affûtée. It is hardly a novel claim that the work of Ursula K. Le Guin (1929–2018) contains influences from philosophical Daoism, but I argue that this influence has yet to be fully understood. Several scholars criticize Le Guin for misrepresenting Daoist ideas as they appear in ancient Chinese philosophical texts, particularly the Dao De Jing and the Zhuangzi. While I have sympathy for this charge, especially as it relates to Le Guin’s translation of the Dao De Jing, I argue that it (...) fails to understand the extent to which her fiction contains her own philosophical development of Daoist ideas. Looking at some of her most influential works (e.g., The Left Hand of Darkness, The Dispossessed, The Lathe of Heaven, A Wizard of Earthsea, etc.), I suggest that Le Guin’s fiction is better seen as a refocusing of Daoist concepts such as complementary contrasts and non-action (wu wei) in the contexts of modern feminism, modern anarchism, science fiction, and fantasy. Le Guin was not trying to represent ancient Daoism as a scholar. Rather, she was trying to reimagine Daoism as a creative artist and philosopher in her own right. This way of viewing Le Guin’s work does not fully exorcise the specter of the possibility of Orientalist cultural appropriation, but it does make the issue more complex in a way that can deepen further conversations. To what extent can an artist be guilty of misrepresentation if representation was not, strictly speaking, her goal? I end with a brief reflection on what is perhaps the deepest philosophical lesson of Le Guin’s work: everything is more complicated than it first appears. On that note, the present article is an attempt not just to do philosophy about Le Guin, but to do philosophy in a Le Guinian fashion, which requires rethinking the metaphor of combat that guides much academic philosophy today. Taiji – sport, méditation, art martial , préservation de la santé, philosophie de vie et voie de l’illumination – est l’une des caractéristiques du daoïsme chinois les plus connues. Cet article cherche à saisir la portée des notions daoïstes classiques, telles que dao , qi et wuwei , ainsi que leur mise en application dans les principes de Taiji tel que pratiqué aujourd’hui à travers le monde entier. Issues de la première génération du daoïsme , ces notions représentent le point (...) central de ses écrits fondateurs et constituent les bases de la philosophie daoïste qui a réussi à préserver son authenticité, malgré de nombreuses évolutions historiques et influences religieuses pendant mille ans, justement grâce à l’application de ces axiomes. INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. “Marx na Universidade!” Esta palavra de ordem sinalizou as reivindicações do Movimento Estudantil, que agitou as universidades alemãs há mais do que cinco décadas, refletindo sobre a missão político-social da formação universitária. O fato de, naquele tempo, a indicação de uma aula sobre a teoria de Karl Marx ter sido sacrificada pela censura dos órgãos políticos da universidade tornou-se incompreensível em nossos dias.[1] Pelo contrário, depois da preocupação intensa com a teoria marxiana nas décadas passadas, o interesse nela parece ter (...) diminuído rapidamente. Acho que foram sobretudo duas razões que levaram a esse processo. Em primeiro lugar, a crítica da economia política foi aceita como teoria científica, tendo enfraquecido assim seu potencial crítico em relação ao desenvolvimento real das sociedades cunhadas pelo capitalismo tardio. Ela tornou-se apenas uma base entre outras na compreensão científica da realidade social.[2] Além disso, a teoria, ela mesma, contém traços objetivistas ao apresentar a análise das estruturas materiais e econômicas, fazendo desaparecer o sujeito humano — fato este, que levou a teoria a aproximar-se aparentemente aos dogmas positivistas da moderna ciência. A teoria de Marx correria, por isso, o risco de mover-se na vizinhança do positivismo científico sacrificando seu impulso emancipatório. Como pôde essa perversão surgir na recepção dessa teoria? Por que esta teoria tão ambiciosa perdeu seu potencial político, deixando-se incluir no pluralismo das teorias científicas? Achando que a teoria de Marx em si mesma não foi inocente quanto a esse processo ou, ao menos, a esse risco, não quero dizer que tivesse refletido de modo insuficiente sobre a emancipação humana. Muito pelo contrário, provarei que a história de sua recepção, assim como a construção teórica da crítica da economia política dão razões significativas para obrigar seu autor a destematizar os sujeitos humanos e, por isso mesmo, chamar a atenção a esse sujeito desaparecido. Em dois passos, explicarei a seguir as razões fundamentadoras dessa tese à primeira vista paradoxal. Na primeira parte da argumentação examinarei o desenvolvimento da teoria de Marx, que se lê como processo de abandono do discurso sobre o sujeito humano, ao passo que na segunda localizarei o destino dos sujeitos e da perspectiva emancipatória, provocados pelas razões internas dessa teoria. Finalmente, incluirei alguns pontos caraterísticos de uma subjetividade humana não dominada pela alienação vigente nas nossas sociedades capitalistas, extraindo assim uma perspectiva produtiva da argumentação anterior. O crescimento da pós-graduação (...) em comunicação no Brasil parece apontar para um futuro promissor em termos de exploração das artes e formas de comunicação audiovisuais. Os artigos aqui reunidos dão igualmente prova da força e da amplitude desse campo, congregando temáticas tão diversas quanto a relação entre o espectador e o documentário ou a cinefilia como forma de consumo contemporâneo. Ocorre que o audiovisual não é apenas um domínio de pesquisa de crescente popularidade na academia, senão também uma das mais poderosas expressões criativas e comunicacionais do homem, capaz de despertar as paixões mais intensas. Isso porque, desde sua origem, as tecnologias audiovisuais sempre se caracterizaram como artes do espanto e do maravilhamento. Numa das lembrança mais marcantes da minha infância, ainda consigo me ver na entrada de um dos belos cinemas da Tijuca (hoje inteiramente desaparecidos, mas tema do cativante estudo histórico de Talitha Ferraz) enquanto espero minha mãe convencer o lanterninha de que tenho mesmo 10 anos de idade – o mínimo exigido para poder assistir à 2001, uma Odisséia no Espaço , obra prima de Stanley Kubrick. Saí do filme sem entender grande coisa, mas inteiramente seduzido pelas impressionantes imagens do vasto espaço sideral e pela sedutora musica de Richard Strauss. Desde esse dia, o cinema se tornou, para mim, uma espécie de religião sem deus (ou com muitos deuses). Nessa cultura das telas em que hoje habitamos, as imagens parecem ter adquirido vida própria. Elas estão em toda parte, conferindo ao mundo certo sabor de permanente fantasmagoria. Aliás, tem sido um tema constante do pensamento apocalíptico esse processo de virtualização da realidade por efeito da multiplicação das imagens eletrônicas. Mas no fundo sabemos que nunca houve para o homem uma realidade que não fosse constituída por imagens. E as fantasmagorias, boas ou ruins, são aquilo que nos oferece suporte e sustentação para um mundo que, de outro modo, provavelmente se encontraria muito mais esvaziado de sentido. Se Edgar Morin inicia seu livro Le Cinema, ou l’Homme Imaginaire com a menção a duas grandes tecnologias legadas a nós pelo século XIX – o cinema e a aviação – é também porque as imagens nos transportam a outros mundos, nos alçam em vôos da imaginação e do pensamento. Da fotografia à arte digital, do televisão ao político, os artigos que reunimos neste numero de Logos compartilham, de diferentes modos, desse sentido de maravilhamento com as imagens. Afinal, elas acrescentam ao mundo uma dimensão suplementar de sentido. Mesmo o extraordinário impacto das imagens digitais, percebido com clareza no êxito de blockbusters tecnológicos como o recente Avatar , de James Cameron, não alteraram esse dado básico de nossa experiência com o audiovisual. De certo modo, é como se estivéssemos ainda nos sentando na sala escura para nos maravilharmos com a ilusão do movimento, lado a lado com os espectadores dos primeiros filmes dos Lumière e de Méliès. Mesmo a pesquisa e a investigação critica do audiovisual não podem furtar-se inteiramente dessa sensação de espanto com as imagens. Um saber que não é temperado pela paixão não tem sentido de existir. E sem uma pincelada de olhar infantil, o que nos poderia ensinar de sempre novo nossa curiosidade com o mundo e nossas estratégias de representá-lo? (shrink)

A crise dos modelos de representação fundadas em unidades coerentes e ordenadas parece ter como um dos traços o que Bruno Latour (1993) chamou de “híbridos”(1). Os híbridos são a figura da multiplicidade que não cabe em categorias e que a modernidade “varia para baixo do tapete”. Atualmente, assistimos ao “retorno dos que nunca foram”, que interpelam de forma contundente nossas formas de vida, fortemente apoiadas na técnica. Mas como apreender os fluxos de discursos e práticas mediatizadas que nos atravessam (...) sem cair nas armadilhas do tecnicismo? Que configurações poderiam hoje assumir práticas e discursos críticos? Que agenciamentos propor? Tentar compreender o estatuto do tecnológico, do político, do artístico, do urbano e do banal como “artes do fazer” parece-nos uma tarefa urgente e necessária. Gilles Deleuze (1977), em “Kafka, por uma literatura menor” (2), deixa-nos uma importante pista, ao afirmar, em sua definição de agenciamento, que “a técnica é antes de tudo social”. A direção nos permite avançar para além das concepções instrumentalistas e dicotômicas da técnica e percebê-la enquanto processo complexo de mediação. De fato, como também afirmava Simondon (1989), os objetos técnicos sempre foram gerados por mediação e geradores de mediação(4). O presente número da Revista Logos traz justamente contribuições para fomentar esse debate e para compor o já vasto quadro das cartografias sobre tecnologia e sociabilidade no Brasil, no campo das possibilidades de mediação sociotécnica. Trata-se de um número especial, organizado dentro da parceria PPGC-Uerj e Centre d’Etudes sur l”Actuel et lê Quotidien (CEAQ) - Paris V, com a colaboração do Professor Stéphane Hugon, coordenador do GRETECH, grupo de pesquisa sobre Tecnologia e Quotidiano. Se, por um lado, o conjunto de artigos compartilha determinados referenciais teóricos, por outro, acolhe também visões próprias, forjadas a partir de diferentes experiências sociais e em distintos contextos culturais. Em comum, todos partem de certa forma da percepção de que as mediações presentes nos processos de sociabilidade podem colaborar nos processos de negociação com as regras e códigos sociais vigentes para inventar outros possíveis. Todos, de certa forma, dão a ver, em seu conjunto, que entramos numa arena onde os diversos elementos que constituem o social interagem e ganham novos contornos: o político não dialoga apenas com o “ideológico”, mas também com o cultural, o subjetivo, o artístico. Da mesma forma, a arte, por exemplo, não diz respeito apenas ao cânone, mas também ao político, ao urbano, ao sensual e ao banal. Com isso, também a noção de tecnologia se amplia e, entendida como “máquina social”, pode ajudar-nos a melhor apreender as dimensões dos fenômenos culturais e de comunicação hoje. Os onze textos reunidos neste número apontam exatamente para o momento singular em que vivemos sob alguns de seus mais diversos ângulos. Stéphane Hugon da Universidade René Decartes-Paris V/CEAQ discute a importância dos processos de apropriação da tecnologia no quotidiano; João Maia e Eduardo Bianchi, da UERJ, abordam a sociabilidade de jovens adolescentes de uma favela carioca como forma criativa de cidadania; Vicenzo Susca, da Universidade René Decartes-Paris V e da Università di Lingue e Comunicazione de Milão, aborda o aspecto subversivo das tecnologias, através de uma perspectiva transpolítica; Beatriz Bretas da UFMG apresenta estudos de caso sobre modos de organização de redes sociais virtuais no Brasil; Fabio Larocca discute como as tecnologias alteram nosso olhar sobre as dinâmicas sócio-espaciais no contexto das cidades; Florian Dauphin faz uma análise do sofware livre na França, país com uma das mais fortes tradições de organização social desse movimento na Europa; José Pinheiro Neves, da Universidade do Minho, recupera a contribuição de Simondon para uma análise da percepção das imagens nas telas dos computadores; Shangsub Choi, do Korea Information Society Development Institute, aborda as mudanças propiciadas pela internet no quotidiano de pessoas e empresas e as possibilidades de contra-poder; a arquiteta e urbanista Julieta Leite aposta na integração das tecnologias digitais aos tecidos da cidade para a construção de novas experiências espaciais coletivas; Maria da Luz Correia analisa a recuperação da comunicação por cartões postais nos dias atuais. Finalmente, Hedi Zamouri faz uma etnografia da Brigada Anti-Pub, movimento contra o abuso da publicidade nos espaços públicos de Paris e José Cláudio Castanheira resenha o último livro de Shetyl Turkle, “História íntima dos objetos”. A Logos 29, edição especial, chega assim aos leitores com uma gama variada de proposições e de lugares de observação, brindando-nos com novas pistas para a análise de questões que compõem a pesquisa atual no campo da comunicação. The abstract notion of “the feminine”, —in French, le f minin, and in German, das Weibliche —as substantivum neutrum, remains together with its opposite, the masculine, connotative of an inherent disparity. It is meant neither as the biological affiliation of sex, nor as gender, the social response, or echo, of this biological affiliation. Rather, it is the spiritual attitude which is the norm for psychic manifestations in general, and is its subtle psychosomatic background. It is not necessarily connected with the (...) rude biological differentiation of sex, but rather appears as a quality in one or the other form; either as the individual, the social group or forms of activities, etc., without respect to the biological manifestations of the participants. What this paper attempts to demonstrate, is the way in which the above described notion of the feminine, functions in classical Asian cultures and philosophies. In the famous Yijing, for instance, this is seen as the hexagram correlated to the male Qian; in the philosophy of Yin and Yang, as Yin the Earth, in correlation with Yang, the Heaven; which are united in the famous Taiji diagram, a sophisticated development of Chinese Neo-Confucianism. The paper focuses on the Dao de jing, in which Lao Zi gives, as a counterbalance to the existing praxis, priority to the female principle. He remains, however, faithful to the Asian tradition, maintaining that the masculine and the feminine should remain equal, correlative, neither one nor the other vying for dominance. The correlative embrace, “When you know the male yet hold on to. the female” subsists in the mythical past where both principles are joined in androgynous unity. (shrink)

Since the outbreak of the Coronavirus disease 2019 (Covid-19), tremendous efforts have been made by scientists, health professionals, business people, politicians, and laypeople around the world. Covid-19 vaccines are one of the most crucial innovations that help fight against the virus. This paper attempts to revisit the Covid-19 vaccines production process by employing the serendipity-mindsponge-3D creativity management theory. Vaccine production can be considered an information process and classified into three main stages. The first stage involved the processes of absorbing information (...) (e.g., digital data and open science) and rejecting unhelpful information (e.g., misinformation and fake news) for effectively acquiring useful insights. Useful insights were later employed by experts, enterprises, governments, and international organizations through interdisciplinary coordinated efforts for developing vaccines within a short period. Finally, the appearance of multiple types of vaccines enabled more strategic options for vaccine distribution and administration. Findings from this vaccine creativity management process could be used as critical lessons for further improvements of vaccination programs. (shrink)

This book surveys the major thinking about Christian ethics as found in books published or distributed in the United States from the mid-sixties to the end of the seventies. In the first half of the book, Professor Long updates the analysis he first expounded in 1967 in his widely praised study, A Survey of Christian Ethics. Part one examines the literature dealing with moral reasoning, thinking about laws and codes, and ethics done in terms of situations and relationships. Part two (...) examines published work that stress the importance of institutions, politics in operational terms, and efforts to think of Christian fidelity as expressed in special communities outside or opposed to the civic mainstream. In part three Professor Long examines works concerned with the nature and function of the moral agent, covering such topics as attention to virtue and character, the nature and role of conscience, and thinking about the implications of moral development theory. Part four describes three new frameworks for doing ethics that have been developed during the last fifteen years: vocational ethics and policy studies; liberation theology; and comparative religious ethics. The Crowd: A Study of the Popular Mind (French: Psychologie des Foules; literally: Psychology of Crowds) is a book authored by Gustave Le Bon that was first published in 1895. In the book, Le Bon claims that there are several characteristics of crowd psychology: "impulsiveness, irritability, incapacity to reason, the absence of judgement of the critical spirit, the exaggeration of sentiments, and others. Le Bon claimed that "an individual immersed for some length of time in a crowd soon finds himself (...) - either in consequence of magnetic influence given out by the crowd or from some other cause of which we are ignorant - in a special state, which much resembles the state of fascination in which the hypnotized individual finds himself in the hands of the hypnotizer. Emmanuel Levinas is one of the most original philosophers in the twentieth century. In this book, continuing his thought on obligation, he investigates the possibility that the word God can be understood now, at the end of the twentieth century, in a meaningful way. The thirteen essays collected in this volume offer an introduction to the wide range of Levinas's thought, addresses philosophical questions concerning politics, language and religion and the philosophies of, amongst others, Heidegger, Kierkegaard, Marx and Derrida.
